Commonwealth v. SA

  • Charges: 1) OUI- Liquor; 2) Negligent Operation
  • Result: Not Guilty

  • Summary: The Defendant was arrested and charged with 1) OUI- Liquor and 2) Negligent Operation, after police responded to a report of a single-car accident. When the police arrived on scene, the Defendant told them he was driving down the street and struck the guardrail after trying to get around another car. The Defendant admitted to having 3 beers and the police located an empty bottle of Guinness in the center console cupholder. The charge of Negligent Operation was thrown out by the Judge at the close of evidence and the jury returned a verdict of Not Guilty on the OUI charge.

Commonwealth v. JS

  • Summary: The Defendant was pulled over after police observed him briefly cross over the center yellow line then overcorrect and cross the fog line at a curve in the road. Through cross-examination of the Commonwealth's witnesses, Attorney Riccio highlighted the fact the Defendant had no other issues driving which would indicate his ability to operate a motor vehicle safely was impaired. The Defendant was convicted of resisting arrest.

Commonwealth v. CR

  • Charge: Receiving Stolen Property + $250.00
  • Result: Not Guilty
  • Attleboro District Court
  • February 14, 2018
  • Summary: The Defendant was alleged to have knowingly bought a stolen dirt bike. Through cross-examination of the Government's witnesses, Attorney Riccio was able to highlight the fact there was no evidence to show his client had any knowledge the bike was stolen, and a verdict of Not Guilty was returned.
