Commonwealth v. JC

  • Summary: On the day of trial, the Government could not go forward on the charge of OUI- Drugs resulting in a dismissal. After subsequent negotiations with the Government, Attorney Riccio secured a dismissal on the Negligent Operation charge, as well.

  • Summary: Police responded to a report of a single-car accident. Upon arrival, police found the Defendant standing outside of his car. The Defendant admitted to striking a utility pole after leaning over to the passenger seat to answer his cell phone. Police testified that the Defendant was unsteady on his feet, had bloodshot eyes, and admitted to drinking a few beers earlier in the day. An officer testified that the Defendant failed field sobriety tests and asked the officer to "give him a break." Police further testified that it appeared the Defendant urinated in his pants. Through cross-examination of the officers and testimony from the Defendant's wife, the jury returned a verdict of Not Guilty on the charge of OUI- Liquor. The Defendant was found guilty of Negligent Operation.

Commonwealth v. SA

  • Result: Dismissed
  • Boston Municipal Court (BMC)- Central
  • June 13, 2017
  • Summary: Attorney Riccio filed a Motion to Dismiss arguing there was no allegation or evidence of property damage. The Government assented to the Motion and agreed to dismiss the case.

Commonwealth v. KB

  • Charges: OUI- Drugs (marijuana), 4th offense
  • Result: Not Guilty
  • Taunton District Court
  • May 8, 2017
  • Summary: After receiving a 911 call from a civilian who reported following a car that was all over the road and struck a telephone pole, the police located the vehicle and observed it crossing the center line and nearly strike the curb. When the vehicle was pulled over, its two right tires ended up on the sidewalk. Police testified that the Defendant fell asleep three different times while speaking with them and admitted to smoking 5-6 joints only 30-45 minutes prior. Police testified that the Defendant had difficulty getting out of his vehicle and eventually fell back into his truck while speaking with them. The Government presented an expert witness who testified to the effects of marijuana. Attorney Riccio successfully argued that the Government failed to establish that the Defendant was under the influence of marijuana while he was driving. The jury returned a verdict of Not Guilty on the charge of OUI- Drugs, 4th Offense, and a verdict of Guilty on the charge of Reckless Operation.

  • Summary: After the Defendant rejected two plea-offers on a previously scheduled trial date, the case was dismissed on its second trial date.

Commonwealth v. TD

  • Charge: Assault with a Dangerous Weapon

  • Summary: On the day of trial, Attorney Riccio argued a Motion to Dismiss which was denied by the Judge. After the Motion was denied, the Commonwealth agreed to dismiss the charge.

Commonwealth v. CR

  • Charges: 1) OUI- Liquor; 2) Negligent Operation of Motor Vehicle
  • Result: Not Guilty
  • Taunton District Court
  • March 7, 2017
  • Summary: Defendant was involved in a motor vehicle accident and when the police arrived on scene Defendant was standing outside of the car by herself. Officer detected an odor of alcohol and the Defendant admitted to drinking earlier in the night. The officer testified that the Defendant swayed during the field sobriety tests and was unable to complete the tests as instructed. After trial, the Defendant was found Not Guilty on both charges.
